Правовое регулирование искусственного интеллекта в корпоративном управлении: сравнительный аспект
Keywords:
corporate governance, board of directors, shareholders, business entity, artificial intelligenceAbstract
This study examines the impact of constant progress and adaptation of artificial intelligence (hereinafter referred to as AI) on the practice of corporate governance. It is applied in three dimensions— business, technology and society. Therefore, in order to assess the need, feasibility, efficiency and responsibility of automating decision-making at the level of the Board of Directors (supervisory body of a legal entity) to ensure effective corporate governance, it is necessary to take into account all regulatory regulators in the field of corporate law. Based on an assessment of the potential and limitations of human and machine learning for effective decision making at the board level, the article proposes five AI-driven management scenarios, i.e., auxiliary, augmented, augmented, autonomous and autopoietic, that can shape the governance of organizations today, tomorrow and in the future. It is also important to understand the implications of both governance and governance by AI in three dimensions, which end in notifying board members to play an active role in understanding, representing, and shaping future AI governance.
